The team has been at the forefront of advice in the area of Land Remediation Relief since its inception in 2001 and will be delivering a key note presentation at the conference to highlight best practice and to update delegates on the latest lobbying activity.

Tax incentives can play a key role in bringing contaminated land back into productive use. Introduced in 2001 and subsequently modified in 2009, the Land Remediation Relief legislation offers companies a 150% tax relief on any qualifying remediation costs providing cash subsidies of up to 30% of the cost of remediation. Since its inception companies have claimed in excess of £3bn of qualifying costs providing valuable cash flow for these often complex projects.

The Fiscal Incentives Group team have been at the forefront of advice in this area of property taxation having represented many of the major housebuilders in both the preparation of claims and leading on subsequent negotiations with HMRC. This allows them to provide insight into current HMRC stance on entitlement conditions and eligibility of costs which in turn provides greater certainty of outcome for clients and the viability of their projects.

The company is also actively involved in promoting brownfield development and are currently working collaboratively with the Environmental Industries Commission and the Home Builders Federation to lobby for a modified and more responsive Land Remediation Relief regime to better support the brownfield development ambitions promoted through the Housing & Planning Act. The primary focus being the introduction of an `above the line` expenditure credit to increase the visibility of the tax relief in the viability appraisal and also to focus on the development of small sites.
